The Trump Administration continues its efforts to violate the 14th Amendment, despite losing at the Supreme Court.
Asian Americans Advancing Justice, the nation’s largest affiliation of independent Asian American civil rights organizations, issues the following statement in response to the most recent Executive Actions on birthright citizenship.
Just six weeks ago, the Supreme Court reaffirmed what the Constitution has guaranteed for more than 150 years and what cannot be changed at the whim of the President: people born in the United States are citizens of the United States. Yet President Trump and his administration continue searching for ways to abridge that constitutional right, this time relying on racialized fearmongering, singling out Chinese families and communities.
These attacks are rooted in old and ugly prejudices. The administration’s renewed assault on birthright citizenship echoes a history of exclusion acts and racialized attacks. It follows the many efforts to stigmatize Asian Americans as perpetual foreigners and to subject us to policies designed to question whether we truly belong in this country.
The Trump Administration does not get to redefine the Constitution. Attempts to carve out new categories of children who are somehow less entitled to citizenship threaten not only immigrant and Asian American communities, but the constitutional rights and protections of everyone.
For generations, Asian American and immigrant communities have fought against exclusion and for the right to fully call this country home. From United States v. Wong Kim Ark to Trump v. Barbara, the law has repeatedly affirmed what our communities have always known: children born here belong here, fully and without question.
We will not allow fear, xenophobia, or political rhetoric to erode that fundamental constitutional protection. Asian Americans Advancing Justice will continue to stand with our communities and defend birthright citizenship against every unlawful attempt to weaken it.
